William McDonough

Bill is a first-chair litigator, trial attorney, and trusted advisor with more than twenty-five years of experience in a wide variety of complex areas and industries, including life sciences, healthcare, insurance and insurance recovery, product liability, construction, mass tort, financial services, fraud, consumer protection, unfair trade practices, real estate, contract disputes, aviation, trade secrets, plaintiffs’ personal injury, and business torts. Bill has represented companies and individuals locally and throughout the country in multidistrict litigations, class actions, consolidated state court proceedings, and single-party cases.

Bill has broad state and federal court experience. He is barred in Pennsylvania and has acted as lead counsel for clients locally and throughout the United States, appearing pro hac vice as trial counsel in Alabama, Arizona, California, Delaware, Illinois, Indiana, Kansas, Missouri, New Mexico, and Texas. Bill has handled all aspects of litigation from the filing of the complaint (or pre-complaint discovery) through appellate argument and everything in between, including developing case strategy, taking fact and expert depositions, preparing and arguing dispositive and Daubert motions, and attending settlement conferences. Bill has first-chair experience in trials and arbitrations, he has attended mediations, and negotiated many settlements on behalf of clients. He also has an active pro bono practice, working mostly on veterans’ issues and cases involving indigent individuals.

Prior to joining FEKM, Bill was an associate and partner at an Am Law 50 firm.

    • Lead counsel in a class action matter defending an operator of assisted living facilities whereby the Court denied the request for class certification.

    • Lead counsel in several cases in a larger consolidated proceeding involving Third Party Payer issues. Bill represented a large multinational pharmaceutical company against claims brought by a health insurer. The Court granted the client’s motion for summary judgment

    • Lead counsel in defending the manufacturer and leading supplier of coffee and tea extracts and other ingredients for the food, beverage, and dairy industries against claims of occupational chemical exposure in a multi-plaintiff case. Plaintiff voluntarily dismissed the client. 

    • Lead counsel in scores of cases in larger multidistrict litigations involving prescription medications and medical devices. Bill represented the product manufacturers and helped formulate overall case strategy, work-up of the cases, and represented the client at mediation and trial.   

    • Lead counsel in all Pennsylvania cases for a multinational healthcare company and manufacturer of cardiovascular and neuromodulation devices   

    • Lead counsel in all Pennsylvania cases for the manufacturer of respirators against claims of occupational exposure to silica

    • Lead counsel in all Pennsylvania cases for the manufacturer of molding products against claims of occupational exposure to asbestos

    • Lead counsel in scores of cases involving claims of breach of contract and unfair trade practices against multiple financial institutions 

    • Lead counsel in representing minority shareholder in shareholder dispute
